• Website will be delivered within 48 hours of deposit receipt and content submission.
• Client receives 2 rounds of revisions included at no extra charge.
• A revision is defined as changes to existing content — text, colors, images, layout adjustments.
• Additional features not included in this agreement are quoted and billed separately.
• Client approves the final site in writing (text or email) before it goes live.
• Site goes live within 24 hours of final approval and final payment.

04 Monthly Maintenance Mantenimiento Mensual

If a monthly maintenance plan was selected, the following terms apply:

• Monthly fee begins on the date the website goes live.
• Billed on the same date each month via Stripe.
• Client may cancel with 30 days written notice via text or email.
• No refunds for partial months.
• Content updates are handled within 48 business hours of request.
• Updates are submitted by the client via text or email to the Webster Gmail.
• Major changes outside the scope of the selected plan are quoted separately.

05 Ownership & Intellectual Property Propiedad y Derechos

• Webster retains full ownership of all code and design until final payment is received in full.
• Upon receipt of final payment, the client owns the website and all its content.
• Client is responsible for providing content they have legal rights to use (photos, logos, text).
• Webster may display the completed website in its portfolio unless the client requests otherwise in writing.
• Webster may retain a copy of the site files for maintenance and backup purposes.

06 Client Responsibilities Responsabilidades del Cliente

• Provide all required content within 5 business days of signing this agreement.
• Respond to revision requests and approval requests within 3 business days.
• Provide accurate business information — Webster is not liable for errors in client-provided content.
• If content is not provided within 5 business days, the project may be rescheduled and deposit is non-refundable.

• Entregar todo el contenido requerido en 5 días hábiles después de firmar.
• Responder a las solicitudes de revisión y aprobación en 3 días hábiles.
• Proporcionar información correcta del negocio — Webster no es responsable de errores en el contenido entregado por el cliente.
• Si no se entrega el contenido en 5 días hábiles, el proyecto puede reprogramarse y el depósito no es reembolsable.

07 Cancellation & Refunds Cancelación y Reembolsos

• The deposit is non-refundable once work has begun.
• If the client cancels before work begins, the deposit may be applied as credit toward a future project.
• If Webster fails to deliver within the agreed timeframe through no fault of the client, a full refund of the deposit will be issued.
• Webster reserves the right to cancel any project if the client is abusive, unresponsive, or in breach of this agreement.

08 Limitation of Liability Límite de Responsabilidad

Webster Web Agency's total liability under this agreement shall not exceed the total amount paid by the client for the project. Webster is not liable for lost revenue, lost customers, or indirect damages of any kind. Webster is not responsible for third-party service outages (Cloudflare, Stripe, Google, etc.).

La responsabilidad total de Webster Web Agency bajo este acuerdo no excederá el monto total pagado por el cliente por el proyecto. Webster no es responsable de pérdidas de ingresos, clientes perdidos, o daños indirectos de ningún tipo. Webster no se hace responsable de fallas de servicios externos (Cloudflare, Stripe, Google, etc.).

09 Governing Law Ley Aplicable

This agreement is governed by the laws of the State of Virginia, USA. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be settled through binding arbitration in Virginia.

Este acuerdo se rige por las leyes del Estado de Virginia, EE. UU. Las disputas se resolverán primero mediante negociación de buena fe. Si no se resuelven, se resolverán mediante arbitraje vinculante en Virginia.

10 Agreement & Signatures Acuerdo y Firmas

By signing below, both parties agree to the terms of this agreement. This contract becomes binding upon receipt of the deposit payment.

Al firmar abajo, ambas partes aceptan los términos de este acuerdo. Este contrato es vinculante al recibir el pago del depósito.
